These Terms & Conditions apply to all purchases made through this website and set out the basis on which artwork, prints, and commissions are sold by Cynthia Sheeamalan.
By placing an order, you agree to these terms.
1. About the website
This website presents and sells original artwork, prints, and commissioned pieces created by Cynthia Sheeamalan.
Content may be updated, changed, or removed from time to time without prior notice.
2. Contract formation
Once an order is placed, an automatic confirmation email will be sent. This email acknowledges receipt of the order but does not confirm acceptance.
A contract between Cynthia Sheeamalan and the customer is formed once:
Payment has been successfully processed, and
A dispatch confirmation or order acceptance notification has been issued
Orders may be declined or cancelled prior to dispatch (see Section 5). Where this occurs, any payment received will be fully refunded.
3. Products
All items are described and presented as accurately as possible. However, please note:
Colours may vary slightly depending on screen settings
Handmade or original works may include natural variations
Sizes and materials are provided as accurately as possible, though minor variations may occur
Each piece is unique unless stated otherwise.
4. Pricing and payment
All prices are shown in GBP.
Prices may be updated from time to time, but confirmed orders will not be affected.
Payment is taken in full at the time of purchase using secure third-party providers such as Shopify Payments, PayPal, Stripe, Klarna, or Clearpay.
Instalment payments (Klarna / Clearpay)
Where available, instalment options may be offered through third-party providers.
By selecting an instalment option, the agreement for payment is made between the customer and the provider. Eligibility, repayment schedules, and any associated fees are managed by the provider in accordance with their own terms.
5. Order acceptance and cancellation
Orders may be declined or cancelled at any time before dispatch, including where:
Payment cannot be authorised
An item is no longer available
An error has occurred in pricing or product information
Fraudulent or suspicious activity is suspected
If an order is cancelled after payment has been taken, a full refund will be issued.
6. Delivery and fulfilment
All artwork is carefully prepared, packaged, and dispatched by hand.
As each piece is individually handled, dispatch times may vary. Where applicable, estimated processing times may be provided at checkout or communicated after purchase. Customers are notified once an order has been dispatched.
Orders are sent via trusted postal or courier services. Once dispatched, delivery times are outside of our control.
Tracking information will be provided where available.
7. Returns and refunds
Due to the nature of original artwork and commissioned pieces, returns are only accepted where items arrive damaged, faulty, or incorrect.
If there is an issue with an order, contact is appreciated as soon as possible, within 48 hours of delivery, along with photographs of the item and packaging.
Where a return is approved, a refund or replacement will be offered in line with statutory rights.
Commissioned or personalised work is non-refundable once work has begun, unless otherwise agreed.
8. Returns with Klarna / Clearpay
For purchases made using Klarna, Clearpay, or similar instalment services, any approved refunds will be processed to the original payment method.
Once a refund has been issued:
The payment provider will be notified automatically
The instalment plan will be updated, adjusted, or cancelled in accordance with the provider’s terms
Any payments already made may be refunded by the provider, depending on their policies
The structure of instalment agreements is managed by the payment provider and is outside our control.
9. Customs and import charges
For international orders, any customs duties, VAT, import taxes, or additional fees are the responsibility of the customer.
These charges are not included in product prices or shipping costs.
10. Intellectual property
All artwork, images, and content remain the intellectual property of Cynthia Sheeamalan, unless otherwise agreed.
Artwork may not be reproduced, distributed, or used commercially without written permission.
Purchasing artwork does not transfer copyright.
11. Website use
This website should be used for lawful purposes only.
We are not responsible for interruptions, technical issues, or temporary unavailability of the website.
12. Liability
To the fullest extent permitted by law, no responsibility is accepted for:
Delays caused by third-party delivery services
Indirect or consequential losses
Issues arising from misuse of products or services
Nothing in these terms excludes liability where it cannot legally be excluded under UK law.
13. Privacy
Personal data is handled in accordance with the Privacy Policy, which explains how information is collected, stored, and used.
14. Changes to these terms
These Terms may be updated from time to time. The most recent version will always be available on this page.
